How to Access CRIA Information

Country Rail Infrastructure Authority acts in accordance with the Government Information (Public Access) Act 2009 (NSW) (GIPA Act) which creates new rights to information that are designed to meet community expectations of a more open and transparent government.

Under the GIPA Act, there are 4 ways that the public will be able to access government information, namely:

  • Mandatory disclosure;
  • Proactive disclosure;
  • Informal release; and
  • Formal access.

Mandatory and proactive disclosure

Pursuant to section 6 of the GIPA Act, CRIA is required to make publicly available certain information (known as “open access information”) free of charge.  Open access information includes:

  • Publication Guide;
  • information about CRIA contained in any document tabled in Parliament by or on behalf of CRIA, other than a document table by order of either House of Parliament;
  • CRIA’s policy documents;
  • CRIA’s disclosure log of access applications;
  • CRIA’s register of government contracts with the private sector (class 1, 2 and 3 contracts)
  • CRIA’s record of the open access information that it does not make publicly available on the basis of an overriding interest against disclosure; and
  • such other information as is prescribed by regulations made under the GIPA Act.

In addition to the mandatory release of certain government information, CRIA is encouraged to make all government information held by it publicly available unless there is an overriding public interest against public disclosure.

Informal release

CRIA may release government information in response to an informal request unless there is an overriding public interest against public disclosure.  CRIA can release such information by whatever means is considered appropriate and subject to any reasonable conditions it thinks fit to impose.

Formal release

CRIA acts in accordance with the GIPA Act which creates new rights to information that are designed to meet community expectations of a more open and transparent government.

A valid formal application for access to government information must:

  • be in writing. An application form is available (click here);
  • state that it is made under the GIPA Act;
  • have an Australian postal address for return correspondence;
  • provide enough details to help the agency identify the information the applicant wants; and
  • enclose the application fee of $30.
